This question just means if anyone helped you in filing the DS-160 form.
But question I was looking for was "Has anyone filed I140 immigrant petition on your behalf?" which pretty much means has anyone started your GC process.

There is not a dull moment this summer for us immigration lawyers, all thanks to good old USCIS. On 8/6/09 USCIS announced that it has reopened the fiscal year 2009 H-2B petition filing period and will immediately accept petitions. This is after closing the cap in January this year.
How could this happen? The Department of State received far fewer than expected requests for H-2B visas and as a result, has issued only 40,640 H-2B visas for fiscal year 2009 to date. This means that there are approximately 25,000 visas that may go unused, as they have not been granted. Because of the low visa issuance rate, USCIS is reopening the filing period to allow employers to file additional petitions for qualified H-2B temporary foreign nonagricultural workers.
But the catch is that filing and processing must be done by September 30, 2009. So those eligible must use the premium processing to do so. Also, employers must submit the Form I-129 Petition for a Nonimmigrant Worker to USCIS with all required documents, including an approved Alien Employment Certification from the U.S. Department of Labor that is valid for the entire employment period stated on the petition. The petitioner must also indicate an employment start date before Oct. 1, 2009. Otherwise the case will be considered for fiscal year 2010.
These are good news for employers in the Hospitality and construction industries, as long as they have approved Labor Certification to be used. My guess is that there are not too many employers that filed for Labor Certifications knowing that visas will not last too long. But this is an indication for the future of the H2B visa and the cap restrictions. We call the government to lift the cap once and for all.

Hello
I have received so many different responses regarding the shots required for over 65s. Our local health department, the INS Doctor and the INS all seem to be providing different information, I'm hoping someone can clarify.
The civil surgeon provided us with a list of shots, basically it contained all the shots including those that I thought were just for children. We went to a public health nurse today who gave us TDP and Varicella shots. Are the MMR, flu and pneumococcal shots required by the INS?
The INS approved Doctor wanted $600 per person for all of the shots. The exam and blood test were $120. We've decided to go to a private Doctor and the local health department for the shots instead of paying the $600. I'm hoping someone can clarify what is needed so that we avoid paying for shots that are not needed.

Here is one last scenario ( perhaps that is why all attorneys are saying - 'continue with your filings and go on with your life' AND all old saws all good old folks at IV might say 'I told you so'). So, not to be let out, here is my take on things to unfold tomorrow:
Why did they wait till Jul 2?
They will release the Aug VB tomorrow. In which they will retrogress most or all categories to 'U'.
They will enforce the 'DMV office rule'. All who have filed on the basis of Jul VB, will be receipted, may be finger printed but AOS adjudicated and GCs issued as dates become current.

By amendent, you mean we should send a letter with the additional document after we get the receipt? Will USCIS be able to match this additional document with the original file?

I am on my 2nd phase of H1B visa which is valid until 2012.
I want to quit my job and go back to my home country.
How long after I quit my job do I get to stay here to wrap up and ship my stuff??
Does that jeopardize my status? I plan to be here for about 30 days after quitting my job. WOuld that be ok? or is it overstaying?
If I ever need to apply for a tourist visa in future will this jeopardize my chances of getting a visa then?

I would appreciate any and all advice that anyone can provide:
My green card was sponsored by my husband, who has a GC. I was travelling out of the country on advance parole, when my passport got stolen, and I had to return to my original country to get a new passport issued, this took some months, during which, my advance parole to travel document expired. SO I could not enter the US. Then, a couple of weeks later, my green card approval, I485 was approved and a notice sent to me in the US. This was in June 2006. Since then, I have not received any other letter/notice, or the GC itself, and I am still stuck outside the US, without my husband. My lawyer is not doing naything about it, and I dont know what I can do?? I have tried contacting the 1800 number, and they say they put in service requests for me, but I have still not received any new information from that end as well, and each time, I have to wait 45 days before they can put in a new service request.
Help!!
Please advise, as it has been so long, and I am still stuck outside the US without my husband.

The choice is pretty clear - apply for your GC (labor).
That way atleast you are in the system and have a PD.
Later on you might have some options to switch from Eb3 to Eb2 with the same or a different employer. Also if uscis manages to clear most of the backlog by end of 2010, then your wait won't be as bad as it has been for folks waiting since 2003.
And maybe even the possibility of a CIR bill next year will speed things up for you.
So the way i see it, things really cannot get any worse for you. So just apply.

My birth certificate does not have my name on it. (in india it is OK to name the new born a few weeks after birth.) so it just says "baby boy" on it:)

Yes you need affidavits from your parents ,it is a common practise in India where the baby is named by the aunt in a naming ceremony

Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

I just wanted to share some good news. I had two approved LCs. One with PD EB3 ROW March 05 and the other with ROW EB3 March 06. I had already filed the I-140 for the March 06 but not for the March 05 one. That was because of the way the job requirement was worded in that LC. The attorney was not sure if it would be approved. Anyway since the earlier PD became current in June I decided to take a chance and file I-140 for that earlier PD LC with PP. And what do you know, it got approved today and that allowes me to file for AOS this month. It was a bit of a gamble with money but it worked!!! :cool:
