I had a soft LUD on my+spouse 485 application today. I am current for this sept but will not be in Oct. Since there are no visa numbers available, I am guessing this must be either a potential RFE or my previous company lawyers may have withdrawn my G-28 representation
Does anyone know if before an RFE , would they or did they get a SOFT LUD, is this common?
Also if my previous attorney withdrew G-28 forms, will this also result in soft lud?

Thanks for your suggestion. My lawyer says that it's fine to have Computer Information Systems as per Education Evaluation draft. Though my lawyers are well experienced, I'm felling little bit doubtful on this.

The most important point to be noted here is:
The job / position should demand a person with Master degree or a Bachelor's degree with more than 5 yrs experience in order to quality for EB2.
Not just having a Master degree or Bachelor's plus 5 yrs experience is gonna help.
So there are a lot of things to be looked at else u will be denied a EB2 labor.

I would really appreciate if someone throws some light on this issue. I am a J1 scholar at the University of Pennsylvania. I do not know what category that is because I am not paid either by my sponsor (upenn) or by my own government(India).
Who does pay you? Don't your paychecks come from UPenn? Even if a company is sponsoring your project, technically the company is paying UPenn, and you are being paid by UPenn.
Now, i wish to get enrolled in a full time MS program of University of Arkansas. In order to do that, should I apply for transfer of J1 from UPenn to U of A ...or should apply of transfer of visa from J1 to F1.
As far as I remember, you cannot be a full-time student in J1. You need to get F1.

In any case, the International Student's Office in U of A will be able to tell you the exact requirements (they will not let you join unless you have the right VISA in hand), and basically you must follow what they say. Typically universities handle visa norms very strictly.

Hi,
I got my I-140 approved last week at Texas Service Center and the status was Approval notice sent. Today, I got an email from CRIS mentioning this case has been transferred to Nebraska Service Center for processing where my I-485 is pending.
Can anybody throw some light on this?

Hello everyone,
I have a question which I hope someone can help answer.I have applied in EB2 category and am from India.My PD is July 2005. I have used AC21 recently and changed my employer(i.e I am no longer with my sponsoring employer) I have not notified USCIS of the same.
I plan to travel to India during September 2008 and use AP to reenter back into the US. Can someone help answer the below doubts.
1) Since at the port of entry the Immigration Officer will ask whether I am still with the same employer or not- I will have to say I have moved to another company- What happens then?
2)Does using the AP and subsequent answer of "Yes- I have changed my company" trigger a RFE during the GC allocation process since now I have to prove to USCIS that my job is "same or similar" and my pay is >= the pay mentioned in my LC.
3) Has anyone successfully used AP after using AC21 and not had an RFE issued during GC allotment?

Some online news said about the proposed EB-6 visa (start-up visa bill) is to get $250,000 funding from US investor into your business and create 5 jobs or 1 Million dollars in profits within 2 years, then the entreprenur will be granted the US green card.
No profits will be guaranteed in any kind of business. Personally I do think this EB-6 visa is very very difficult to work because it is NOT easy to find someone to invest those big sum of money into your business during this great economic recession. So I am thinking about why don�t give out green cards to international students who have advanced degree in Science & Medicine regardless of whether those students have a US job offer or not. It is because immigration of those international students lead to the inflow of knowledge and money to US and it will indirectly increase the US reputation and uplift the US economy. I do believe the inflow of knowledge and money are keys for immigration which are welcomed by all other countries in this world. Since those international students are trained by US and they are familiar with the US surroundings, therefore, I do think the inflow of money for immigration should be brought back to US. Also, if US absorb those inflow of knowlegable groups for immigration, US will become more and more famous in the world leadership of Science and Innovations. All rich and knowlegeable groups will be concentrated in US for world leadership. Moreover, those international students will buy houses, cars, computers and set up their own business for daily living and these will indirectly uplift the retail buying power and consequently uplift the US economy. In addition, more relatives or friends from those international students will be indirectly invited as visitors to US and these will increase the profits of the retail business, hotel reservations, restaurant business and airline tickets reservation. Also, those students established the companies to US will hire 1-5 persons and these will create job opportunities in US. All those inflow of money will bring tremendous monetary income to US economy.
For those poor people who want to immigrate to US, we can give him a chance either to start up a business on their own to hire 1-5 persons or to invest a small to medium sum of money to those advanced degree graduates� business. Finally more jobs created, more people visit US for tourism and more money inflow for better US economy!!

I agree. For example, in Germany, it is hard to work if you do not speak German. Also in France and all others.
And even in Scotland, they speak different English there and you need to be there for many months before you get used to it.

Why is Gary looking outside of USA to tap potential home buyers? Just for folks who aren't aware - there are 500,000 high skilled legal immigrant already in USA who are waiting in queue for numbers of years to get their Permanent Residency. Thanks to the limited visa availability based on country chargeability (birth of applicant) and inefficiency of immigration system, these highly skilled, tax paying and law abiding immgrants are waiting for their Green Card (Permanent residency). Some of them have studied here, worked here for years and US is almost a second home to them. They are sitting on pile of cash, Yes - PILE OF HARD CASH. They wouldn't buy house or any big ticket items until they get Green card. Why not give these people, who are already part of our system, conditional Permanent Residency who buy houses. This will also get us immediately required cash and home inventory will go down as much as 300K at minimum. P.S. I AM TALKING ABOUT HIGH SKILLED LEGAL IMMGRANTS AND NOT ABOUT ILLEGAL IMMIGRANTS.

If you are in the process of applying for H1 through another employer, you may be safe. As with everything USCIS, H1 revocation takes couple of months before it is approved. So in the interim you may get your new H1 approved before the previous employer's revocation sails through.

I am on my 2nd phase of H1B visa which is valid until 2012.
I want to quit my job and go back to my home country.
How long after I quit my job do I get to stay here to wrap up and ship my stuff??
Does that jeopardize my status? I plan to be here for about 30 days after quitting my job. WOuld that be ok? or is it overstaying?
If I ever need to apply for a tourist visa in future will this jeopardize my chances of getting a visa then?

I am a july 07 filer with EB2 PD Oct 2005. I switched employers in early part of this year. My employer has been very erratic and not paying me salary for past 2 months because his money is not cleared from his client. I have found another contract but my employer wants to wait until his money is cleared before he can pay me and that can take longer than 6 months !!! (if his money is not cleared before)
Under such circumstances I am jeopardising everything. I was wondering if I start working for my own company on a W2 with a same job profile same salary structure will USCIS consider this as something fraudulent or do they allow self employment under AC21 ? After I have my GC I plan to continue working for my own company. In that case what do I need to do from my side to make this happen ? I started my company in August 2008.
