    I am in same boat.. I am going mumbai india in feb for stamping. Where are you going for stamping. I heard lately that there is no way we can pre check PIMS. I have asked my lawer but haven't got reply yet.. If you lawer has sent duplicate copy of H1b document to Kentucky Visa center then there should not be issue.( 99.99 % should be safe ).. If not then there is risk involved.

    Do you know how a lawyer can send the duplicate copy to Kentucky visa center, my h1 got approved 3-4 weeks ago, can we still send the duplicate copy to kentucky visa center ??? Did you do that ??

    Once you have two pay stubs , you can change the company. You can change even with a single pay stub but with two you are much safer.

    Its a very debatable thing to discuss whether leaving so soon is good or not ..... wont go into it. You should always do what is best for you and your family. Everything else comes later.....

    Just trying to understand what would that statement indicate for next/future visa bulletins. It can be deciphered in different dimensions ie:
    - all visas have been allocated and all upto priority date have been allocated (second one may not be true) .. this leads to no retrogression (or) no movement in next bulltin
    - all visas allocated and not all people allocated .. which may lead to retrogression in next bulletin

    There are many other combination of interpretations as well.

    Taught of debating if it is worth to live here more ??

    Basically I came here to earn some money and to have some good life ( cleaning my bathroom myself -- lol )

    The way things are going here in US with Jobs / Economy overall thinking if it is worth to live here and worth to get a US Passport or to keep renewing GC.

    I know it all depends on each indivisual perspective and views.. but taught of looking other views on this.

    I don't think your lawyer knows what he's talking about. All you need is your I-140 receipt. I applied for my wife on July 2 and used my I-140 approval notice. Did not even include the I-485 notice as the instructions did not ask for it. The simple solution is to go online and download the official instructions and figure out for yourself.

    I got myself in somewhat of a mess here and wondering if there is any solution?

    I filed for my I-485 on June 28th and it reached UCSIS on 2nd July. I wasn't able to do the same for my wife as she was in India at that time.

    She is back now and I want to file her I-485 but my lawyer tells me I can not do that because it either needs to be filed concurrently with mine or they need to have a receipt for my I-485 which doesn't seem to be coming in the next few weeks.

    Is there anything else I can do? Anyone has similar experiences? Will a copy of my I-485 filing do?

    Hello everybody ! I am 22 years old. My parents had applied for GC under the employment based category. I, unfortunately, aged out before my parents applied I-140 because of the stupid backlogs. So I aged out even before an I-140 was filed. I was reading the Child protection act info and could not understand if I will be "automatically classified to the appropriate category" for GC which is Family 2B and retain my "original PD." Does this apply to me as I had not even filed I-140 when I aged out ? My parent's PD is Oct 2000 so does this mean I am under Family 2B with Oct 2000 PD ?? Please help me out. I am sure many of you with sons/daughters that are in a similar situation. Thanks

    My son also aged out before my I140 was filed. I was told that he would not be able to keep the same priority date and it would be fixed by the date when I could apply for his family based application. So, if I were to file an I130 next week his priority date would be March 2008.

    In order for the priority date to be fixed at the point when labor certification was applied for the I140 would have to be submitted before his 21st birthday and be approved within a time period that could be deducted from his age at time of approval, making him under 21 at that time.

    The child status protection act is pretty useless to children in your position or my son's since the big delay occurred in the labor cert stage.

    If however, you can find a different interpretation of this situation feel free to send me a personal message and I will follow through as well.

    There are a number of members in IV whose children aged out so while this is not a prevalent subject matter it is one that affects more people than you might realize.

    Thanks all for attending the meetup. It is very important to keep the chapter active.

    Minutes of the Meeting:

    nixtor updated the chapter on:

    (1) State Department's Forecast on the Visa Bulletin for the remainder of the year

    (2) Immigration legislation progress on the hill & WH so far

    (3) Miken Institute Global conference on Housing and Immigration.

    The DC/MD/VA chapter decided to meet every month and one of the agenda is to have more members participate voluntarily and contribute which is very vital for our efforts.

    Hi Gurus,

    I need some advice from you guys

    My initial receipt date for I-485 from Vermont service center was July 7th 2007. But when I-485 was transferred to Texas service center, receipt date on I-485 is showing as September 11th 2007. Can we do anything to correct the wrong receipt dates as this might have significant impact on my processing times. Please advice

    Gurus,
    I have completed 4 years on H1B and I converted to L2 status and applied for EAD(feb'10) thru my Spouse's L1 Visa.

    My GC is in process and not filed my I-485 yet.

    Now my question is, as if i stay L2 for 1 year and if i convert it back to H1B, will my H1 term Start all over and will i get additional 6 year term? Please provide your feedback

    Hello experts,
    Here is a situation of my friend .
    1.He lost his and his wife's passport alongwith the receipt notices and FP notice.The current visa which has expired and I-94 is also lost.

    If he is in states then he can apply for new passport .For FP Notice he can just walk in to office get FP done on that day provided he has copy or A number with him .
    Apply for duplicate copy of H1B approval ,I think it cost @ 200 - 300 $
    2.The lost passport includes the old passport with old visa in it.

    Get duplicate copy of h1b and go outside usa and get visa stamp on new passport.
    Can you please throw some light as to what are his options.

    I believe you have to be in the US when your 140 is applied. Same goes for 485. Check with your lawyer. Once 140 or 485 is applied, you can travel outside.

    I'm on H1 and My spouse is on H4 (came on H4 in Dec 2003)
    We are both Canadian PR's. I worked out a deal with my US based to company so that I work in Canada and come to USA occasionally.

    Here are a few questions regd my spouse


    Planning to apply for H1 in April 2007, Once H1 is approved
    -Can we use automatic revalidation to enter USA without getting our visa's stamped. My h1 expired in 2006 and my spouse;s H4 expired in 2006.
    (remember my spouse is applying for H1 )
    -How safe it is FrequENTLY travel to Canada and back
    -How safe it is to stay in Canada for duration of 3-6 months and come back to USA
    -Once my spouse gets the H1 approved, should he move to H1 immediatly or can continue on H4?
    -stamping of H1 (first stamping for H1 in Canada) after conversion from H4

    I probabably know the answer of this question but would still like to confirm, just to be sure:

    - First I-797B Valid from Jan 2004 to Sep 2006 <- Note: wasn't for 3 years
    - First Visa valid from Jul 2004 to Sep 2006
    - 1st US Entry Date from Aug 2005 till present date
    (been to india in Dec 2007 for 1 month for visa stamping)
    - First i-94 valid from Aug 2005 to Sep 2006


    -Extended I-797A from Sep 2006 to Jan 2009 <-Note: not extended for 3 yrs
    -2nd Visa/I-94 valid from Dec 2007 to Jan 2009

    My questions?

    1. Can my H1B Visa be extended again? This will be my 2nd extension.

    2. Till what Date can be extended?
    a. Jan 2010 (6 yrs from 1st I-797)
    b. Jul 2010 ( 6 yrs from 1st visa stamping)
    c. Aug 2011 (6 yrs from 1st US entry)

    Hi,

    I have a master's degree from a top US university but my current employer applied my GC in the EB3 category. I am planning to move to a different company which is willing to apply in the EB2 category. I have an approved 1-140 with the current employer and my I-485 was sent in July/August. Here are the steps I think I should take after moving to the new company:

    1) After I move to the new company, I can send AC-21 and continue my GC in the Eb3 category.
    2) File a new LC. Send new I-140 in EB2 asking them to use the old PD from the approved EB3 category.

    My question is
    1) Will I run into any issues for my EB3 because the new I-140 is in EB2? I dont want to jeopardise my EB3 application.
    2) Should I not send AC21 if I am planning to switch to EB2 category. My current employer does not revoke I140 even after I move to the new company (anyway, I am doing this after 180 days of I-485).

    Any input is appreciated.
