As usual to complicate decision making.... :mad:
Today PD (aug 2006 / EB3) is now current :) and I have my I 140 approved.
I also have another job offer which looks great. :confused: But they will start GC only after 3-4 months!
I feel It will be better file I-485.. Change after 6 months.
Should I just stick on to my current job and ride it out for 6 months to get EAD?
When does one get EAD 3 months after filing 485 or after 6?
Also if the dates retrogress, will 485 get approved? or Should the date remain current till 485 gets approved?

I hope most of our members are writing/meeting their congressmen regarding our issues (thru state chapters etc.). Since CIR is about to be discussed in the Senate is it worthwhile to send a petition to all judiciary committee members? Maybe we can use one of those onlinepetition websites and encourage all members to virutal sign it. A petiton with a large number of signature might have a favorable response rather than an individual writing to a local congressman (I always get a standard one page response even though I change text and highlight one aspect of our issues). What is your opinion on this exercize - is it useful?
Ofcourse meeting the lawmakers thru state chapter is the best and members can continue to do that. The above is a complimentary action (and which need members to sign a petition).

fionaapple20: Safest and clean route is to find an another employer and transfer H1B. Make sure your current employer does not revoke your 140, in case if its not approved. Additionally, it is highly recommended to invoke AC21 after your 140 is approved and 180 days passed.

Need some help/advice on PERM LC issue:
My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters OR Bachelors with 5 Yrs experience),
On may'09 got a query saying "Discrepency in Alien education and experience".
Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.
my employer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"

Wait till you get your new H1 if possible and enter with new visa stamped on your passport. That is the cleanest way. You can also enter with previous H1 visa(with previous employer) and show the new I797. But i recommend you to go for cleanest approach.

My I-485/I-140 were filed on Jul 2, 2008 (I-140 approved in 9/2007). I possess an EAD valid till Sep 2010 and AP valid till Aug 2009. I lost my job (H1B) in late January. I have a family emergency compelling me to travel to India for a week (starting Saturday next week 04/04/2009). Will there be any problem in terms of using my AP to re-enter the U.S? An early reply would be appreciated. Thank You very much in advance.
P.S: I do not have a job yet.

Health care reform has been passed for good or bad only time will tell.
But suffice to say it will give 30 million Americans some kind of coverage to seek medical care meaning more physicians are needed to provide care for these folks.
IV in the past had been working on excluding non-immigrant physicians from the EB category.Now that Health care reform has been passed, has anything been included in it for physicians practicing in rural areas(immigration benefits) ? If not i think we have missed a golden opportunity.
But suffice to say it will give 30 million Americans some kind of coverage to seek medical care meaning more physicians are needed to provide care for these folks.

I am July filer got 485 RFE
seems like my prev attorney made a mistake and answered yes to "Have you ever before applied for permanent resident status in the U.S"
- well this is going to cost me
My question(s)
i changed job(and company) do i need to send AC21 along with RFE response.
and also can i send my medical records along with RFE (medical records i submitted are incomplete and says chickenpox vaccination needed now i am vaccinated and got the records of it).
if yes do i still need USCIS doctor to submit these medical records.

If you knew that your prev attorney made a mistake, you could have send a note to USCIS about this error at that time itself. Since you kept this quite, now you have to pay principal + interest.

WOW! they'll accept applications without medical examinations. Wish I had known that before sending my second app. :( Seems like USCIS is more forgiving this time around - you think the flowers had something to do with it?;)
Hope they treat my G-325 oversight the same way and issue an RFE instead of outright rejecting the application. (Fingers crossed)

check with your attroney, in general you can do concurrent I-485 filing along with I-140 (or) if your I-140 pending you can still apply for I-485 with I-140 filing. But I never did this, so check with your attroney now and do it. good luck
